THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE Dr. JUSTI CE SHAMEEM AKTHER C.M.A. No. 554 of 2005 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) Sri T. Balaji, learned counsel for the appellant, addressed letter dated 24.07.2017 to the Registry stating that the appellant seeks to withdraw this appeal.

Sri T. Balaji, learned counsel, is also present in person and reiterates this prayer. He would further state that in the light of the withdrawal of the appeal, the amount due and payable in terms of the award passed by the Arbitrator, which was confirmed by the learned Principal Senior Civil Judge, Tirupati, in Arbitration O.P.No.51 of 1995, may be remitted to him.

Accepting the prayer of the learned counsel, the appeal is dismissed as withdrawn. It shall be open to the appellant to initiate appropriate measures to secure payment of the amount in terms of the award which has now attained finality, if the same is not remitted by the first respondent within reasonable time.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
