13.12.2021 LK,J I.A.No.1 of 2021 This application is filed seeking relaxation of condition No.(iv) imposed in Crl.P.No.316 of 2020, dated 23.01.2021, by this Court that 'petitioner/accused shall appear before the Investigating Officer on every 15 days i.e., on second and fourth Saturday of every month between 10.00 AM and 02.00 PM till filing of charge sheet and cooperate with the investigating agency'.

Learned counsel for the petitioner submits that the petitioner has been complying with the said condition. It is submitted that entire investigation is completed and final report also filed. Therefore, condition No.(iv) may be relaxed.

Per contra, learned counsel Special Public Prosecutor submits that investigation is still pending and they have not filed the final report. As such, the petitioner is not entitled for relaxation of the said condition.

Taking into consideration the fact that order was passed on 23.01.2021 and ever since the petitioner is complying with the said condition, this Court deems it appropriate to modify the said condition to the extent of "the petitioner/accused shall appear before the Investigating Officer, as and when his presence is required. Further, respondent police shall give an advance notice to the petitioner in this regard".

Accordingly, this application is ordered.
