HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17940 of 2016 ORDER:

This writ petition is filed seeking issuance of Mandamus declaring the action of respondent Nos.2 to 4 in not taking any action on the complaint made by the petitioner on 22.03.2016 with regard to the illegal and unauthorized construction made by the 5th respondent on the pathway in active collusion with 6th respondent, who is the President of B.N. Reddy Colony Welfare Association, situated at Street No.2, B.N.

Reddy Colony, Vanasthalipuram, Hyderabad, Ranga Reddy District, as arbitrary and illegal.

Heard the petitioner, being a party-in-person, as well as the learned Government Pleader for Municipal Administration and Urban Development Department appearing for respondent No.1, and also Sri Pasham Krishna Reddy, learned Standing Counsel for respondent Nos.2 to 4. Since the request of the petitioner is only to consider his complaint dated 22.03.2016, it is not necessary to hear the un-official respondents. Sri Pasham Krishna Reddy, learned Standing Counsel for respondent Nos.2 to 4, submits that the complaint dated 22.03.2016 filed by the petitioner is still pending and the same will be considered in accordance with law.

Having regard to the facts and circumstances and without going into the merits of the case, this writ petition is disposed of directing respondent No.2 to consider the complaint dated 22.03.2016 submitted by the petitioner and pass appropriate orders in accordance with law, as early as possible, preferably within a period of six weeks from the date of receipt of a copy of this order. It is needless to mention that respondent No.2 shall hear the petitioner as well as unofficial respondent Nos.5 and 6 before passing any order on the complaint dated 22.03.2016 submitted by the petitioner. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
