THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.986 of 2019 ORDER:
The grievance of the petitioners is directed against the endorsement dated 21.07.2018 of the Tahsildar, Devarkadra Mandal, Mahboobnagar District, whereunder the Tahsildar rejected their plea for conducting demarcation of different extents of land in various survey numbers of Devarkadra Village on the ground that their names did not find mention in the list of pattadars of the lands in the subject survey numbers.
It is brought to the notice of this Court that the aforestated decision of the Tahsildar, Devarkadra Mandal, Mahboobnagar District, would be amenable to appellate review under Section 11 of the Andhra Pradesh Survey and Boundaries Act, 1923, which would have application in the State of Telangana, and in terms of the Circular dated 25.07.2001 issued by the Special Commissioner and Director of Survey Settlement, Andhra Pradesh.
In that view of the matter, as the issue sought to be raised by the petitioners would involve resolution of disputed questions of fact, it would be appropriate that they avail the appellate remedy. The writ petition is accordingly dismissed on this short ground leaving it open to the petitioners to avail the appellate remedy in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
