THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 11774 of 2012 ORDER:

This writ petition was filed challenging the proceedings issued by respondent No.1-District Statue Committee on 17.03.2012 according permission for erection of statue of late Sri.Y.S.Rajasekhar Reddy, former Chief Minister of Andhra Pradesh in the Island Centre at the junction of Janapadu road on NarketpalliAddanki High Way Road in Piduguralla Town and Mandal, Guntur District.

This Court by order, dated 23.04.2012, issued notice before admission and directed respondent No.3-Pidugurlla Municipality to get instructions in the matter, but no order was passed. Even after four years, no counter-affidavit is filed by the respondents. However, learned counsel appearing for the respondents, on the basis of instructions, submits that though the statue was erected, it was not unveiled as the permission was not accorded by the Commissioner and Director of Municipal Administration on the basis of the resolution passed by respondent No.3.

Recording the said statement, the Commissioner and Director of Municipal Administration is directed to take appropriate decision in accordance with law. If the petitioner is aggrieved by the decision of

the Commissioner and Director of Municipal Administration, it is open to him to take appropriate steps in accordance with law. The writ petition is accordingly disposed of.
