HONOURABLE DR. JUSTICE B. SIVA SANKARA RAO I.A.Nos.3 to 5 of 2019 IN/AND Crl.R.C.No.35 of 2019 ORDER:

IA.No.3 of 2019 is allowed as the compromise petition containing the signature of the accused attested by jailer and representing by his son with permission besides defacto complainant present.

I.A.Nos.4 & 5 of 2019 are filed by them to compound the offence against the accused.

As it is stated the accused is in jail unable to secure means, with great difficulty the family members could settle the amount with the defacto complainant and paid in full satisfaction.

Taking into consideration of the pitiable circumstance, the compounding amount is imposed on the cheque of Rs.2,00,000/- of 5% is Rs.10,000/- payable to the Chief Justice Relief Fund.

Since the parties want to pay said amount, the matter is passed over. Later, proof of payment receipt from the Account Section of the High Court, of payment of Rs.10,000/- as compounding fee is filed and the same is recorded. In view of payment of compounding fee and compromise of the parties, the offence is compounded and the conviction judgments of the lower Courts by virtue of this order are set aside and the accused is acquitted. The bail bonds of the accused, if any, shall stand cancelled.

Dr.SSRB,J In the result, both the I.A.Nos.4 & 5 of 2019 and the Criminal Revision Case are allowed. Pending miscellaneous petitions, if any, shall stand closed.
