THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.5972 of 2016 ORDER:

The petitioners, who are accused Nos.1 and 2 in Crime No.122 of 2015 of V.Madugulu Police Station, Visakhapatnam District, filed the present application under Sections 437 and 439 Cr.P.C. seeking enlargement on bail in the above crime, registered for the offences punishable under Section 20 B (1) read with 8 (c) of NDPS Act. Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing for the respondent-State. The only ground urged by the learned counsel for the petitioners is that they are in judicial custody from 01.12.2015 onwards and hence they may be released on bail.

Leaned Public Prosecutor opposed the application. It is evident from the record that the petitioners were found transporting 220 Kgs. of Ganja. As the quantity of ganja seized from the possession of the petitioners is more than commercial quantity, since the earlier petition filed, vide Crl.P.No.14138 of 2015, seeking bail was dismissed on 11.01.2016 and in the absence of any change in fact or law, I am not inclined to grant bail.
