(GHMC) submits that this writ petition may be disposed of as his client is prepared to give a hearing to the petitioners on the issue involved herein. In view of the aforesaid submission, we dispose of the writ petition directing the GHMC to issue a notice to the petitioners and on receipt of the same the petitioners shall appear before the officer concerned. The officer concerned shall take into consideration all the objections raised by the petitioners in their letter dt.16.3.2015, examine the material which might be produced at the time of hearing and take a decision in accordance with law with reasons, within six weeks from the date of receipt of a copy of this order and such decision shall be communicated to the petitioners. Thereafter, it would be open for the parties to take steps in accordance with law as may be advised.
Till such decision is taken, no coercive measures shall be taken against the petitioners. In the meanwhile, the cheque presented by the petitioners to the respondent shall not be encashed. We make it clear that in the event the petitioners do not turn up in spite of service of notice, then this order passed by us will stand recalled and the issue is a closed chapter. Pending miscellaneous petitions, if any, shall stand closed. There will be no order as to costs.
