HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11131 OF 2017 ORDER:

This Writ Petition is filed questioning the direction issued by the 4th respondent-Prohibition and Excise Superintendent, Nandyal, to close their wine shops, as they are located within the distance of 500 mtrs., of the outer edge of the National Highway / State Highway.

Heard the learned counsel for the petitioners and the learned Government Pleader for Prohibition (Andhra Pradesh). Perused the record. The petitioners also had applied to permit them to locate their shops in new premises. Now, learned Government Pleader for respondent authorities submits that the applications of the petitioners for shifting their shops to alternative places have been granted. This aspect of the matter is not being disputed by the learned counsel for the petitioners. In those circumstances, the relief claimed in the writ petition has become infructuous.

Accordingly, the Writ Petition is closed. No costs. As a sequel to disposal of the writ petition, W.P.M.Ps., if any, pending shall also stand closed.
