THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.424 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime.No.200 of 2023 on the file of Kesamudram Police Station, Mahabubabad District, registered for the offence under Section 8 (c) r/w. 20 (b) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Kesamudram Police while conducting patrolling duty at Gandhi Nagar found this petitioner under suspicious circumstances carrying two bags. On enquiry, they found this petitioner in possession of kg.16.290 gms. of ganja. After following the due procedure prescribed under NDPS Act, the petitioner was arrested and remanded to judicial custody. 4.
Learned counsel appearing for the petitioner would submit that petitioner has been falsely implicated in the case, he has
nothing to do with the contraband seized and sought for relief of bail.

Since the contraband seized is intermediary quantity, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:- i) The petitioner/Accused shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties i.e., one local surety and the other from the native place, for a like sum each to the satisfaction of the Special Judge for Trial of Cases for the offences under Narcotic Drugs and Psychotropic Substances Act, 1985Cum-Principal Sessions Judge, at Mahabubabad. ii) The petitioner/Accused after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday for a period eight weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
