Heard Mr.M.V.Suresh for petitioners and the Assistant Government Pleader (Home).
The petitioners pray for the following relief :- " ..... to issue an order or direction more particularly one in the nature of writ of mandamus directing the entrustment of the investigation in Crime No. 230/ 2017 before Lalapet Police Station to CB-CID and for a consequential direction to conduct investigation in Crime No. 230/ 2017 dt 13-08-2017 after taking statements of the various victims in the hands of the 4th Respondent herein and to take further steps as per law....." . Mr.M.V.Suresh submits that real or substantial grievance of petitioners is that the 3rd respondent on one hand is not receiving complaints filed by petitioners against 4th respondent and on the other hand making G.D. entry and registering FIR. At the same time, in the pending FIR, though the 3rd respondent is taking the details of all the affected persons, in the hands of 4th respondent, the 3rd respondent is not recording the statements as part of investigation in Cr.No.230 of 2017.
The grievance appears to be bona fide. However, having regard to the stage at which the jurisdiction of this Court is invoked, without expressing any view on the merits, the writ petition is disposed of by this order.
a) The petitioners are given liberty to send complaints by registered post with
acknowledgment due to 3rd respondent by enclosing a copy of this order.
b) The 3rd respondent is directed to make G.D. entry and proceed in accordance with law, on the complaints received from petitioners.
Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
