THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.435 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.195 of 2023 on the file of Gudur Police Station, Mahabubabad, registered for the offence under Section 302 of IPC. 2.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that A-3's husband was killed by A-1 to A-3. A-3 instigated A-1 to kill the deceased. Accordingly, they executed a plan to kill the deceased. The deceased accompanied A-1 to Warangal and from there they went to scene of offence. A-2 was asked to come to the scene of offence by this petitioner and there they strangulated the deceased. 4.
Learned counsel appearing for the petitioner would submit that A-4 was granted bail by this Court and A-2 and A-3 were granted by the learned Session Judge on 10.01.2024.

A perusal of the order of the learned Sessions Judge reveals that it was informed by the learned Public Prosecutor before the Court below that entire investigation is complete except for receipt of FSL report. On the said ground, bail was granted. 6.
Since investigation is complete and other accused were already granted bail, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial First Class Magistrate, at Narsampet.
ii) The petitioner/Accused No.1 after release shall appear before concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for the purpose of investigation till filing of charge sheet.
iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 7.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
