THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.11475 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.4 seeking grant of anticipatory bail in crime No.274 of 2015 on the file of the Sangareddy Town Police Station, Medak District, registered for the offence under Sections 120-B, 418, 420, 464 read with Section 34 IPC and Sections 81, 82 and 83 of the Registration Act.

Heard and perused the records.

When the case is taken up for hearing, learned counsel for the petitioner submits that co-accused approached the Court by way of invoking Section 482 of CrPC. wherein this Court passed order directing the police to strictly adhere to the provisions of Section 41-A of CrPC. Hence, he prays this Court to dispose of the petition in the same terms.

Considering the above submission of the learned counsel for the petitioner, the criminal petition is disposed of directing the police to follow the procedure laid down in Section 41-A of CrPC prior to arrest of the petitioner herein.
