This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A1, in Crime No.116 of 2017 on the file of Paykaraopeta Police Station, Visakhapatnam District.

The offences alleged are under Sections 354(c) and 384 r/ w 34 IPC. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The Public Prosecutor brings to the notice of this court, that earlier this petitioner filed similar petition viz.,Crl.P.No.12489 of 2017 and A2 and A3 filed Crl.P.No.12472 of 2017 and this court by a common order, dated 27.12.2017, while granting anticipatory bails to A2 and A3, dismissed the petition filed by this petitioner, by considering the merits of the case, holding that the allegations against this petitioner are grave in nature and thereby, declined to grant anticipatory bail to this petitioner/ A1.

Hence, when the similar bail petition is dismissed by this court, on merits, this petition cannot be entertained at all. 5.

With the above observations, the Criminal Petition is dismissed. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the court below. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
