THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43243 of 2016 ORDER:

In this writ petition, the petitioners seek to quash the proceedings in LTR Case No.5 of 2015 Gundala, on the file of 2nd respondent as arbitrary and illegal.

Since this Court is not inclined to interfere with the impugned orders dated 09.09.2016 as the appeal preferred by the petitioners against the impugned orders is pending with the 4th respondent, the learned counsel for the petitioners confined his argument to the extent of giving a direction to the authorities concerned not to dispossess the petitioners from the premises in dispute till the 4th respondent decides the application filed in the appeal for grant of injunction. Considering the facts and circumstances of the case, without going into merits of the case, the writ petition is disposed of directing the 4th respondent to dispose of the injunction application filed by the petitioners along with the appeal as expeditiously as possible. Till such time, the 3rd respondent is directed not to dispossess the petitioners from the property in dispute. No costs.
