This criminal petition is filed under Sections 437 and 439 of Cr.P.C to enlarge the petitioner on bail in connection with Crime No.125 of 1998 of Tangutur Police Station, registered for the offence punishable under Section 395 of IPC.
It is the case of the prosecution that the above crime was registered in the year 1998 and after completion of entire investigation charge sheet was filed, which was split up against A3 and A4 was numbered as S.C.No.353 of 2002 and the case split up against A2 and A6 was numbered as S.C.No.182 of 2003 and that the same were ended in acquittal.
Learned counsel for the petitioner/A1 in the above crime submitted that the petitioner is not aware of pendency of any crime against him, and that he was arrested on 02.09.2016 at 07.00 P.M. without producing him before any Court.
On filing of W.P.No.30144of 2016 by the mother of the petitioner before this Court, he was produced before the Court in connection with the above crime.
Learned Additional Public Prosecutor submitted that the petitioner was absconding for the last more than nine years and in case, the petitioner was enlarged on bail, there is every possibility to flee from justice and prayed to dismiss the criminal petition.
After arguing the matter for some time, learned counsel for the petitioner requested this Court to direct the Sessions Court to dispose of the sessions case within three months. In view of the request made by the learned counsel for the petitioner, without touching the merits of the case, I deem it appropriate to direct the Sessions Court to decide the matter within three months from the date of receipt of a copy of this order. With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions in the petition, if any, shall stand closed.
