Questioning the communication, dated 20.01.2019, issued by the 3rd respondent, intimating the action taken against Petition No.1906 of 2018, on the file of Kusumanchi Police Station, Khammam District, the present writ petition is filed.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Learned counsel for the petitioner submits that through the impugned communication, dated 20.01.2019, the 3rd respondent informed the petitioner that there is no incident of threatening occurred on 05.08.2018 and therefore, the authorities cannot register any case as this matter is pending before the High Court. Learned counsel further submits that without first registering a case, the authorities cannot issue such communication. Learned counsel disputes the date of the said communication, on the ground that it has been served on the petitioner only during November, 2019.

On perusal of the record, it is seen that, upon the petitioner making a representation, the 3rd respondent has given number to the said representation as Petition No.1906 of 2018, on 23.12.2018, conducted preliminary enquiry, and on enquiry, it is noticed that a there is no incident of threatening occurred as complained by the petitioner, based on which, the impugned communication is issued. If the petitioner is aggrieved by the said communication, it is open for the petitioner to avail appropriate remedies before the proper forum in accordance with law.

With the above observation, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
