THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.29851 of 2014 ORDER:

This Writ Petition is filed challenging the action of the 2nd respondent in issuing proceedings, dated 02.08.2014, and consequential notice of the 3rd respondent, dated 04.09.2014. 2.

A reading of the notice issued by the 3rd respondent shows that certain encroachments were noticed in respect of land situated in Survey No.101/12 of Nagole Village and the parties mentioned therein were asked to be present on 09.09.2014. 3.

Learned counsel appearing for the 6th respondent submits that in spite of the order of status quo granted on 01.10.2014, the proceedings went on and the position was clarified by this court in W.V.M.P.No.1183 of 2015 on 03.02.2016 giving liberty to the 3rd respondent to go ahead with the matter and bring final orders to the notice of this Court.

It appears that the 3rd respondent passed an order on 08.06.2016 and against the same, the parties preferred an appeal and the matter was remanded to the 3rd respondent. After remand, the 3rd respondent passed an order on 27.12.2016. 5.

In view of the same, the present Writ Petition has become infructuous and it is open to the petitioners to take appropriate proceedings in accordance with law against the order passed by the 3rd respondent on 27.12.2016, if they are so advised.
