Heard the learned Senior Counsel for the petitioners and the learned Government Pleader for Revenue.
The grievance of the petitioners is that the 3rd respondent was granted orders of mutation rejecting their objections and against the said order, dated 29-11-2014 passed by the 2nd respondent, they have preferred an appeal and pending before the 1st respondent since 28-01-2015. The petitioners have sought early hearing of the stay petition or the appeal and it is stated that the appeal is posted for hearing on 22-08-2015. The petitioners have filed the present writ petition apprehending that the 3rd respondent is likely to alienate the land in question, thereby creating third party rights and, therefore, it is imperative that the interim application of the petitioners filed in the appeal atleast be heard and disposed of expeditiously. It is not necessary to issue notice to the 3rd respondent in view of the order proposed to be passed.
Keeping in view the pendency of appeal before the 1st respondent since 28-01-2015, it is appropriate that the 1st respondent hears the appeal or the interim application on the date fixed for hearing i.e., 22-08-2015. Hence, the writ petition is disposed of directing the 1st respondent to hear the parties on 22-08-2015 and if for any reason it is not possible to dispose of the appeal, pass appropriate orders atleast on the stay application filed by the petitioners. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand
closed.
