Sri A.K. Kishore Reddy, learned counsel for the petitioner, seeks permission of this court to withdraw the criminal petition with a liberty to raise necessary defense, during crossexamination of any witness or in the defense evidence, regarding proper service and validity, of notice under Proviso (b) to Section 138 of Negotiable Instrument Act, 1881.

Permission accorded.

Accordingly, the criminal petition is dismissed as withdrawn granting liberty as prayed for.

Miscellaneous petitions, if any, pending in the criminal petition shall stand closed.
