HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.12628 OF 2014 ORDER:
This Writ Petition is filed seeking writ of mandamus declaring the inaction of the 1st respondent in disposing of the appeal filed by the petitioners vide File No.C/2160/03, under Section 5-B of the A.P Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act'), even though 11 years have been elapsed, as arbitrary and illegal and consequently direct the 1st respondent to dispose of the said appeal expeditiously.

Heard learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for respondents 1 and 2.

As can be seen from the record, the petitioners filed an appeal vide file No.C/2160/03 under Section 5-B of the Act before 1st respondent-Revenue Divisional Officer, Nalgonda District, Bhongir (now Bhongir District), for mutation of entries in the revenue records. According to the petitioners, the said appeal is not disposed though 11 years have been elapsed. Hence, they pray to issue a direction to the 1st respondent to dispose of the appeal expeditiously. 4.
In view of the submissions made by the petitioners, this Writ Petition is disposed of directing the 1st respondent -
Revenue Divisional Officer, Nalgonda District, (now Bhongir District) to dispose of the appeal said to have been filed by the petitioners, after hearing both sides, as expeditiously as possible, but not later than twelve (12) weeks from the date of receipt of a copy of this order, if the said appeal is not already disposed of. No costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
