THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.1026 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners, seeking verbatim the following relief: '..to issue a writ or order more particularly one in the nature writ of mandamus or an appropriate writ or order declaring the inaction of the 5th respondent in sending the reports (NOC) to the 3rd respondent as per the reports dated 08.12.2015 of the VRO, Surveyor and Mandal Revenue Inspector, for grant of permission for decasting the sand from the petitioners agricultural patta lands to an extent of Ac.23.00 Ac.8.15 guntas in Sy.Nos.

233, 234, 238, 239, 240, 241 and 235, 236, 237, 173, 180, 181 & 182, respectively in Bangaruchelika Village, Kothagudem Mandal, Bhadradi Kothagudem District (Old Khammam District) of the petitioners and others is illegal, arbitrary and unconstitutional and contrary to the procedure established under G.O.Ms.No.3 dated 08.01.2015 and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice.' I have heard the submissions of the learned counsel appearing for the petitioners, of the learned Government Pleader appearing for the respondents 1 & 3, and of the learned standing counsel appearing for the 4th respondent.

Learned counsel for the petitioner submits that though the 5th respondent is required under law to send his report to the 3rd respondent based on the reports of the Village Revenue Officer, Surveyor and Mandal Revenue Inspector for grant of permission for decasting of sand from the subject lands, he failed to do so and, therefore, the writ petition is filed. Having regard to the facts and submissions, this Writ Petition is disposed of directing the 5th respondent to send his report to the 3rd respondent, as required under law, as expeditiously as possible and preferably within three (03) weeks from the date of receipt of a copy of this order.

There shall be no order as to costs.
