HON'BLE SRI JUSTICE S. RAVI KUMAR SECOND APPEAL No.299 of 2001 JUDGMENT:

Advocate for appellant filed a letter seeking permission to withdraw second appeal and a third party petitioner who filed S.A.M.P.No.1769 of 2014 opposed for withdrawal.

2. Heard both sides.

3. Since appellant wants to withdraw the appeal, the third party petitioner, who is not yet impleaded as party, has no right to oppose the request of appellant. Therefore, the objection of the third party petitioner is overruled and permission is granted to appellant to withdraw second appeal.

4. Accordingly, second appeal is dismissed as withdrawn. No costs.

5. Miscellaneous Petitions, if any, shall stand dismissed.
