THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT APPEAL NO.1413 OF 2017 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} As the appellant has an effective alternate remedy of appeal under Rule 42(2) of the Rules Relating to Certain Taxes and the Lodging of Moneys Received by the Gram Panchayat and Payment of Money from the Gram Panchayat Fund, 1995 (issued under G.O.Ms.No.30 dated 20.01.1995) to the District Collector, we see no reason to examine the matter on merits. Suffice it if the order under appeal is set aside and the appellant is permitted to prefer an appeal to the District Collector. In case the appellant files such an appeal, the District Collector shall consider the same and pass orders thereupon in accordance with law, as expeditiously as possible, preferably within ten days from the date of filing of the appeal by the appellant herein.

The Writ Appeal is disposed of accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
