Heard Sri Srinivasa Rao Putluri, learned counsel appearing for the petitioners and Sri O.Mahoner Reddy, learned Standing Counsel appearing for the respondents-TSSPDCL.

2. This writ petition is filed seeking to declare the proceedings of the 2nd respondent dated 01-12-2014, in assessment of back billing of an amount of Rs.1,76,523/- in respect of the petitioners' Agricultural Service Connection bearing No.271100359 Category LT V(A), situated at Survey Nos.72 (Part) and 61 (Part) of Mamidipally village, Saroornagar Mandal of Ranga Reddy district without any notice as illegal, arbitrary and consequently set aside the same.

As per Condition No.3.4 of the General Terms and Conditions of Power Supply of the consumer category cannot be reclassified without issuing notice and affording opportunity to the consumer for filing objections within a period of 15 days. The learned counsel appearing for the petitioners submits that in the instant case, no such notice is given.

Therefore, the respondents are directed not to disconnect the power supply in respect of the petitioners' Agricultural Service Connection bearing No.271100359 Category LT V(A), situated at Survey Nos.72 (Part) and 61 (Part) of Mamidipally village, Saroornagar Mandal of Ranga Reddy district till any decision is taken for reclassification duly following Condition No.3.4 of the General Terms and Conditions of Supply Clauses.

The learned counsel appearing for the petitioner brought to the notice of this Court that the authorities of the respondents came to the premises today for the purpose of disconnection and he apprehends that disconnection might have been done already. In such an event, the respondents shall restore the power supply to the

petitioners' Agricultural Service Connection bearing No.271100359 forthwith.

6. The writ petition is disposed of accordingly. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
