Heard.

The petitioners are aggrieved by the inaction of the 4th respondent in entertaining and registering the sale deed proposed to be executed by them with respect to the lands admeasuring Ac.3-77 cents in Sy.No.216/3 and Ac.2-32 cents in Sy.No.382/5 situated at Kammuru Village, Kuderu Mandal, Anantapur District. The petitioners claim to be the owner of the said lands from the time of their father and claim the lands by inheritance as private patta lands. Since the proposed sale deed having been not accepted by the 4th respondent, the petitioners filed the present writ petition.

Learned Government Pleader has received instructions, wherein it is stated that as per RSR Adangal and 1-B Register of Kammuru Village, the land admeasuring Ac.3-77 cents in Sy.No.216/3 is classified as Government land and the land admeasuring Ac.2-32 cents in Sy.No.382/5 is classified as patta land. Obviously, the petitioners seek to execute the sale deed covering both the said survey numbers and since Sy.No.216/3 is classified as Government land, the directions as sought for cannot be given. It is, however, open to the petitioners to present the sale deed with respect to the patta land in Sy.No.382/5. As the relief claimed in the writ petition is based on the common sale deed covering both the said survey numbers, no relief can be granted to the petitioners in this writ petition.

With the above observation, the writ petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
