THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.6459 OF 2016 ORDER:

When this Court took an objection about maintainability of the petition without impleading the de-facto complainant, learned counsel for the petitioner Sri P. Nagendra Reddy sought permission to withdraw the criminal petition with a liberty to file fresh application before the Trial Court, impleading the de-facto complainant.

In view of the request made by the learned counsel for the petitioner, the criminal petition is dismissed as withdrawn, according liberty to renew his request of filing fresh application before the Trial Court by impleading the de-facto complainant, and on filing such application, the Trial Court is directed to decide the matter in accordance with law.

In the result, criminal petition is dismissed as withdrawn. Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
