THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1113 of 2019 ORDER:
The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue a writ or order/s more particularly one in the nature of Writ of Mandamus and other Writ order or direction declaring the action of the respondent no-4 in entering the nature of land as Assigned land / Laoni Patta in remarks column of E-Pass Book bearing no.T11060080774 and consequently direct the respondent no-4 to make correction in the E-Pass Book and pahani for the year 20172018 classified land admeasuring Acc.12-26 guntas in Sy.No.812/11 situated at Yanampally Shivar, Dichpally Mandal, Nizamabad District as patta land instead of assigned land and pass such other order/s as this Hon'ble Court may deem fit and proper in the circumstances of the case.'
Perusal of the record reflects that the petitioner did not approach the revenue authorities concerned if she was aggrieved by the entry of the words 'Laoni Patta' in the remarks column of the e-patta passbook issued to her on 21.08.2018.
Learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court that if a proper application is made, necessary action would be taken thereon by the Tahsildar, Dichpally Mandal, Nizamabad District.
It may be noted that the pattadar passbook already issued to the petitioner under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971, does not contain any entry to the effect that the land in question is a Laoni patta land. That being so, it appears that the Tahsildar, Dichpally Mandal, Nizamabad District, made an entry in
the e-patta passbook issued to the petitioner without proper application of mind.
The writ petition is accordingly disposed of permitting the petitioner to make an application to the Tahsildar, Dichpally Mandal, Nizamabad District, with regard to the entry 'Laoni Patta' in the remarks column of the e-patta passbook issued to her on 21.08.2018. The Tahsildar, Dichpally Mandal, Nizamabad District, shall take appropriate action upon such application as and when made. The exercise in this regard shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of such application.
