THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39410 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in not completing the investigation in Crime No.133 of 2016, dated 22.10.2016, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that the petitioner is the absolute owner of the land to an extent of Ac. 6.25 cents in Survey No.145/1 of Sankalapuram Village, Banaganapalli Mandal, Kurnool District and that in the early hours of 19.10.2016, the petitioner found that the black gram crop in his agricultural land was completely spoiled and on the next day, the petitioner made a complaint to the 3rd respondent against respondents 4 & 5, who trespassed into the petitioner's property and destroyed the crop. The 3rd respondent has registered the same as Crime No.133 of 2016, but till now, the 3rd respondent has not taken any action against respondents 4 & 5.

Learned Assistant Government Pleader for Home submitted that the 3rd respondent is investigating the matter and he will file charge sheet, as expeditiously as possible.

Recording the said submission, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
