ORDER
This writ petition is filed seeking to declare the action of the respondents in not recovering the amount from respondents 6 and 7, who have impersonated the names of the petitioners and withdrawn the compensation by filing false affidavits, and not releasing the balance compensation in favour of the petitioners, as illegal and arbitrary.

The brief facts are that the first petitioner and the father of second petitioner were in joint possession and enjoyment of the agricultural land admeasuring Ac.1-34 gts in Sy.No.624 situated at Madikonda Revenue Village, Warangal, after the death of the father of first petitioner. While so, the petitioners came to know that the said land was acquired for formation of four lane road and respondents 6 and 7 had withdrawn part of the compensation awarded by the 4th respondent by filing false affidavits impersonating their names. Subsequently, the 2nd petitioner made a representation dated 26.09.2018 to the 3rd respondent seeking to recover the amounts from respondents 6 and 7 and pay the entire compensation to them. But the same has not been considered by the 3rd respondent.

Learned Government Pleader for Revenue, has placed before this Court the instructions received from the 4th respondent-
CKR, J W.P.No.1021 of 2019 Revenue Divisional Officer, wherein it is stated that as no objections were received either from the petitioners or any others before payment of compensation pertaining to the land in Sy.No.624/2, the compensation for the land to an extent of 3035.25 sq. meters, was paid to the 6th respondent-Sri Thoutireddy Sudharshan Reddy, likewise, compensation for the land to an extent of 3003.94 sq. meters, was paid to the 7th respondent-Sri Thoutireddy Laxma Reddy.

In the light of the aforesaid instructions, interest of justice would be served by giving liberty to the petitioner to challenge the award passed by the respondents.

With the above observation, the Writ Petition is closed. No order as to costs. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
