HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 31145 OF 2017 ORDER:
This Writ Petition is filed complaining that the 2nd respondent Committee has not been considering the proposals of the petitioners for fixation of tuition fee in respect of 3-year and 5year LLB Course for the block period 2017-18 to 2019-20 on the ground that they have failed to submit the proposals online within the cut-off date.
The specific case of the petitioners is that, pursuant to the notification issued by the 2nd respondent, they made application within the time stipulated.
Learned counsel for the petitioners places reliance on the order of this Court, in W.P. No. 20826 of 2017, dated 31.07.2017, wherein this Court has taken a view that even in cases where applications are made beyond the time stipulated by the notification, the 2nd respondent is duty-bound to consider the same as fixation of fee is qua the institution. Heard learned Government Pleader for Higher Education (Andhra Pradesh) and Sri C.Sudesh Anand, learned Standing Counsel for respondent No.2.
Having considered the respective submissions and, inasmuch as petitioners are ready to pay late fee, and there being no objection for the 2nd respondent to consider the application of the petitioners on payment of late fee, there shall be a direction to the 2nd respondent to process the application of the petitioners after accepting the late fee, as may be demanded by the 2nd
respondent, within a period of 12 (twelve) weeks from the date of receipt of a copy of the order.
With the above observations, the Writ Petition stands disposed of. No order as to costs.
Consequently, the miscellaneous applications, if any shall stand closed.
