HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.6725 OF 2008 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ in the nature of a writ of Mandamus or any other appropriate writ, direction or order declaring the Show Cause Notice VR/IBP dated 18.03.2008 as well as the letter VR/IBP dated 22.03.2008 of the Senior Divisional Retail Sales Manager, Indian Oil Corporation Limited, the 1st respondent herein as illegal and void and pass."

When the matter came up for hearing, learned standing counsel appearing for 1st respondent, producing a copy of letter dated 26.11.2008 issued by the 1st respondent to the petitioner, would submit that as per the said letter, the 1st respondent in view of the findings of the 4th TT sample having failed, the Corporation agreed with the explanation dated 13.06.2008 of the petitioner and given benefit to the petitioner and in that view, no final order is required in this writ petition. Sri P.Kamalakar, learned counsel for petitioner is present and reported no objection for closure of the writ petition.
