THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.13202 of 2017 ORDER:

Heard Sri P.Gangarami Reddy for petitioners and the Assistant Government Pleader (Revenue) for respondents. The petitioners grievance is that the 2nd respondent before whom the appeal is filed against order under Section 6 of the A.P.Land Encroachment Act, 1905, dated 31-03-2017 has not granted stay as on date.

The petitioners voiced apprehension that on one hand the prayer for staying the order dated 31-03-2017 is not considered and on the other hand, for any reason with the expiry of period available for filing the appeal, if the respondents come and demolish the house, the petitioners will be put to great loss and hardship. Hence, pray for appropriate directions. The Assistant Government Pleader consents to direct the 2nd respondent to dispose of the appeal within three months from the date of receipt of a copy of this order and pending disposal of the appeal, status-quo as on today in all respects may be directed to be maintained by both parties.

The statement is placed on record.

The writ petition is disposed of by this order. (a) The parties are directed to maintain statusquo in all aspects vis-à-vis the subject matter of order dated 31-03-2017 pending appeal.

(b) The 2nd respondent is directed to hear and dispose of the appeal as expeditiously as possible within three months from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly. No order as to costs.
