None appears for the petitioner. There is no representation on behalf of the petitioner when the matter is taken up.

The petitioner herein sought for quashing Crime No.119 of 2012 pending with the Mahila Police Station, Vijayawada City, Krishna District, registered for the offence under Sections 498-A, 494 and 506 of the Indian Penal Code. The 2nd respondent herein is the complainant. It is alleged by the 2nd respondent wife that her husband has developed illegal intimacy with the petitioner herein and when she confronted him, she has been subjected to an assault and has been necked out of the home. Therefore, she moved away to Vijayawada and started living there. It is the specific case of the complainant that her husband married the petitioner also at Sri Venkateswara Swamy Temple, Jaggaiahpet, Krishna District, on 27-07-2012. The petitioner Smt. Hymavathi was the wife of Sri Gollaprolu Srinivasa Rao, who worked as a Reserve Inspector of Police and died. Hence, the 2nd respondent wife lodged the complaint with the police.

The husband of the respondent herein has filed Criminal Petition No.370 of 2013 to quash the very same Crime No.119 of 2012 pending with the Mahila Police Station, Vijayawada City, Krishna District, and this Court rejected the same for the reasons recorded in its order dated 15-06-2015.

Since a prima facie case is made out, I do not see any warrant for quashing Crime No.119 of 2012 pending with the Mahila Police Station, Vijayawada City, Krishna District. The Criminal Petition is, therefore, dismissed. ----------------------------------------- NOOTY RAMAMOHANA RAO, J
