- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.70 OF 2018 ORDER :

This Court in W.P.No.24672 of 2017 & batch on 15.11.2017 while adjourning the matter to 21.11.2017 permitted conducting of interviews and that the appointment orders should contain the cause that their appointments would be subject to further orders in the writ petitions.

On 22.11.2017 this Court directed not to finalize the selections until further orders. Alleging violation of the said direction, this contempt case is filed.

According to the averments of the 1st respondent, the copy of the order passed by this Court on 15.11.2017 and 21.11.2017 were received by the University on 28.11.2017. Whereas, the Executive Council approved the appointments on 20.11.2017 and orders were issued for the post of Professor on 21.11.2017 and therefore contend that there is no deliberate and willful violation of the directions of the Court. This stand of the respondent is not disputed.

Having regard to the specific assertion of the 1st respondent that they were not in receipt of the orders issued by this Court on 15.11.2017 before 21.11.2017, not stipulating the condition clause in the order of appointment cannot be held as violating the directions of the Court. Further the promotions were affected and appointment orders were issued on 21.11.2017. Therefore, it cannot be said that the respondents have violated the order of this

- 3 - Court much less willful and deliberate, warranting initiation of proceedings under the Contempt of Courts Act. 5.

Having regard to the above observations, the Contempt case is closed. Pending miscellaneous petitions, if any, shall stand closed.
