HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.1034 of 2019 ORDER:
This Writ Petition is filed seeking a Writ of Mandamus to direct the respondents to regularize the services of petitioners, who have been working in Adult Education Department on contract basis for nearly eight years in Adult Education Department or in any Government Department duly taking into consideration their length of service, experience and qualification.
Heard Mr.K.R.Srinivas, learned counsel for petitioners and the learned Government Pleader for Education.
It has been contended by the petitioners that they were appointed as Mandal Co-ordinators on contract basis in the Adult Education Department to work in Sakshara Bharat Programme. When the Sakshara Bharat Programme has been discontinued, the services of the petitioners were disengaged. The 3rd respondent addressed letter to the 4th respondent on 23.06.2018 recommending the cases of petitioners for any suitable employment. The 3rd respondent has also recommended the cases of petitioners to the 5th respondent for suitable employment. But, so far, respondents 4 and 5 have not passed any orders on the recommendations submitted by the 3rd respondent. Therefore, appropriate orders be passed directing respondents 4 and 5 to pass appropriate orders on the recommendation made by 3rd respondent in accordance with law.
Learned Government Pleader submits that the cases of the petitioners will be considered in view of the recommendations
made by the 3rd respondent and appropriate orders would be passed in accordance with law.
This Court, having considered the rival submissions, is of the considered view that the writ petition can be disposed of directing respondents 4 and 5 to consider the cases of petitioners basing orders on the recommendations made by 3rd respondent and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is accordingly disposed of. No order as to costs.
