THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.42601 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the third respondent in not filing the Final Report/Charge Sheet in Crime No.482 of 2015 dated 17.10.2015 lodged by the petitioner, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Government Pleader for Home representing respondent Nos.1 to 3. 3.

A perusal of the record reveals that basing on the complaint lodged by the petitioner, the Station House Officer, III Town Police Station, Rajahmundry, registered a case in Crime No.482 of 2015 for the offence punishable under Section 406 I.P.C. against respondent Nos.4 and 5. For one reason or other, the third respondent has not completed the investigation. 4.

At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the third respondent to complete the investigation as expeditiously as possible. 5.

In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case.

Having regard to the facts and circumstances of the case, the third respondent is hereby directed to complete the investigation in Crime No.482 of 2015, as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. _________________________ T. SUNIL CHOWDARY, J Date: 02.05.2018 Ivd
