THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.10638 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue writ order or direction more particularly one in the nature of Writ of 'Mandamus' declaring the action of the 2nd respondent in not paying the full VRS compensation amounting to Rs.80,62,668/- to the petitioner instead paid an amount of Rs.56,62,668/- as VRS compensation as illegal, arbitrary, unjust and discriminatory and contrary to Article 14 of the Constitution of India and consequently direct the respondents to pay the full VRS Compensation amount of Rs.80,62,668/- duly adjusting the amounts already paid as VRS compensation to the petitioner immediately together with interest @18% on the balance of VRS Compensation to be paid to the petitioner in the interest of justice duly considering the representation of the Petitioner dated 20-08-2015 and to pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."

2. Heard Sri D.Ramakrishna, learned counsel, appearing for the petitioner.

When the matter is taken up, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 20.08.2015 to the 2nd respondent and no orders have been passed on the said representation so far and a necessary direction may be issued to the 2nd respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe.

4. Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any

opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the 2nd respondent to consider and pass appropriate orders on the representation dated 20.08.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of three months from the date of receipt of a copy of this order.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 31.03.2016 SS
