ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.9 and 11 in Crime No.184 of 2025 before the

Karankote Police Station, Vikarabad District, registered for the offences punishable under Section 109, 118(1), 115(2), 126(2), 352, 351(2) read with 3(5) of BNS and Sections 3(1)(r)(s) and 3(2)(v)(va) of SC/ST (PoA) Act.

The brief facts of the case are that the de facto complainant lodged a complaint alleging an incident arising out of prior disputes between two groups, and due to previous enmity, falsely implicated the petitioners, who were arrayed as accused Nos.9 and 11, though they were not involved in the alleged incident. The petitioners' names were shown as absconding in the remand case diary despite their availability in the village. The complaint did not attribute any specific overt acts to the petitioners and contained only vague allegations that they attacked the complainant with sticks. The case was alleged to be politically motivated, and the police completed the investigation except for filing the charge sheet. 3.

Heard Smt. Akula Sunitha, learned counsel appearing on behalf of the petitioners as well as Sri M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are arrayed as accused Nos.9 and 11 and are in no way connected with the above-said crime, and that the allegations are only against accused Nos.1 to 8, who were already arrested and released on bail. She further submitted that the allegations against the petitioners do not attract the provisions of the SC/ST Act. Therefore, she prayed the Court to grant pre-arrest bail to the petitioners by allowing this Criminal Petition.

On the other hand, the learned Assistant Public Prosecutor submitted that notice was sent to the de facto complainant and the same was refused. He further submitted that the investigation was completed except for the filing of the charge sheet and that there are no other cases pending against the petitioners. He contended that the petitioners also beat the complainant with hands and sticks and that custodial interrogation of the petitioners is necessary. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners are arrayed as accused Nos.9 and 11 and the allegations against them are that they also beat the victim with hands and sticks. Further, as seen from the record, the material part of the investigation was completed and accused Nos. 1 to 8 were already arrested and released on bail. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to the following conditions: i.

The petitioners shall surrender before the Station House Officer, Karankote Police Station, Vikarabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the

Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
