THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33333 of 2017 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Revenue appearing for the respondent Nos.1 and 3 to 5, Smt.A.Jayanthi, learned counsel for the second respondent, and Ms.Vijayalaxmi, learned counsel for the sixth respondent.

In the present Writ Petition challenge is to the State Support Agreement, dated 25.06.2008, entered into between the first respondent and the sixth respondent-company. According to the learned counsel for the petitioner, the impugned action on the part of the respondents is highly illegal, arbitrary and violative of the Fundamental Rights guaranteed under the Constitution of India. Petitioner alleges cheating and land grabbing against the official respondents and eventually states that the respondent Nos.1 to 6 are liable for prosecution. It is also the averment in the affidavit, filed in support of the Writ Petition, that the petitioner herein made several representations to the Government requesting to solve the problems but all the efforts proved to be futile. The affidavit also alleges unfairness on the part of the Government and favouritism in favour of the sixth respondent.

Admittedly, in the present Writ Petition, the petitioner herein challenges the State Support Agreement dated

25.06.2008. The affidavit, filed in support of the Writ Petition, does not disclose any semblance of reason to approach this Court at this length of time. The affidavit also does not disclose any valid reasons for this abnormal delay of nearly one decade in approaching this Court under Article 226 of the Constitution of India. In the considered opinion of this Court, the said delay alone is sufficient for rejecting the present Writ Petition.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, shall also stand disposed of.
