THE HONB'E SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1622 OF 2017 ORDER:

The writ petition is filed questioning the auction notice dated 05.01.2017, issued by the 6th respondent to conduct the auction of lease hold rights of the land on 19.01.2017 with respect to the petitioner's property in Sy.No.42/1, over an extent of Ac.4.81 cents, Chidipi Village, Kovvuru Mandal, West Godavari District, pending disposal of the Appeal No.2 of 2016 before the 4th respondent. Learned counsel for the petitioner, on being confronted with the letter dated 20.06.2016, given by the petitioner himself that he would vacate and hand over the subject land by December, 2016. Learned counsel for the petitioner, on instructions, submits that a reasonable time may be granted for the petitioner to vacate the subject land as he has already sown red gram crop. Petitioner had also filed an affidavit on 24.01.

2017 before this Court stating that he would vacate the land in question and hand over the same to the temple authorities by the end of April, 2017. The affidavit filed by way of an undertaking is taken on record. In those circumstances, the writ petition stands disposed of with a direction to the respondent-authorities to allow the petitioner to continue and carry on agricultural operations till the end of April, 2017. Petitioner shall not further sow any crop and vacate the subject land by 30.04.2017 in terms of the undertaking filed before this Court. It may also be noted that the violation of undertaking shall invite the contempt proceedings against the petitioner.

With the above observation, the writ petition is disposed of. No order as to costs.

Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
