This appeal is preferred by the appellant/claimant questioning the order of the Motor Accident Claims Tribunal-cumIII Additional District Judge, Tirupati (for short, Tribunal) in M.V.O.P.No.653 of 2010 dated 10-05-2013, on the ground that the compensation awarded by the Tribunal is very meager. 2.

Heard.

While appreciating the evidence of Pw.2 doctor, the tribunal has declined to accept 30% disability and only considered the disability at 5%.

Having considered the health condition of the appellant/claimant, I am inclined to grant another 5% disability and if 10% disability is applied to the annual income of the appellant at Rs.60,000/-, the compensation under that head comes to Rs.6,000/- and the age of the petitioner was 37 years at the time of accident and appropriate multiplier to the age of petitioner, is 15, and therefore, the compensation under the head disability and loss of future income comes to Rs.90,000/- (Rs.6,000/- x 15), as against Rs.45,000/-. The amount awarded under other heads need not be interfered.

Accordingly, the Motor Accident Civil Miscellaneous Appeal is allowed in part. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
