The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ, Order or Direction more particularly in the nature of Writ of Mandamus, direct the respondents 2 to 4 to take action against the 5th respondent in implementing the notice BA No.

11285/2015/ACP-IV dt. 16.09.2015 issued by the 2nd respondent under Section 452 of HMC Act and to remove the unauthorized constructions raised by the 5th respondent in accordance with HMC Act in view of in Violation of Building Plan No. 11285/15/ACP-IV dt. 7.4.2015 and to pass such other order or orders that the Hon'ble Court may deem fit and proper in the interest of justice."

Sri S. Lakshmi Narayana Reddy, learned Standing Counsel for the Greater Visakhapatnam Municipal Corporation, informed this Court that pursuant to the notice dated 16.09.2015 issued under Section 452 of the Greater Hyderabad Municipal Corporation Act, 1955, orders were issued under Section 636 of the said Act on 15.02.2016. Aggrieved thereby, the fifth respondent was stated to have approached the Court of the learned Senior Civil Judge, Visakhapatnam, by way of O.S.No.148 of 2016, wherein she filed I.A.No.198 of 2016 for interim relief. Learned Standing Counsel further stated that the trial Court granted an order of status quo thereon.

In the light of the afore-stated developments, it is for the petitioner to work out his remedies in accordance with law, if he has any grievance with regard to the construction made by the fifth respondent.

Reserving liberty to the petitioner to do so, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand

closed. No order as to costs.
