Heard learned counsel for the petitioners, learned Government Pleader for Revenue for respondents 1 to 4 and learned Government Pleader for Forests for respondent No.5. 2.
On 07.08.2019 the District Collector, Bhadradri Kothagudem, passed orders canceling the assignment granted to petitioners to an extent of Ac.2-30 guntas in Sy.No.17/59 of Laxmidevipally Village, holding that the said assignment was granted on forest land and the same is not valid in law. Aggrieved thereby, petitioners preferred appeal on 16.09.2019, before the Chief Commissioner of Land Administration acknowledged by the office on the said date. Along with the appeal, petitioners filed application for grant of stay of operation of the orders of the District Collector. Alleging inaction on the stay application and the appeal, this writ petition is filed. 3.
With consent of learned counsel for the petitioners, learned Government Pleaders for Revenue and Forest Department, the Writ Petition is disposed of, directing the appellate authority to consider the appeal or the stay application as the case may be, by affording due opportunity to the respective parties, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of copy of this order. Pending miscellaneous petitions, if any, shall stand closed.
