THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5884 of 2015 ORDER:
The writ petitioner is aggrieved of the inaction of the 1st respondent in either disposing of the revision or the stay application in the revision filed against the order dated 17.01.2015 passed by the 2nd respondent.
2. The averments in the writ affidavit are to the effect that the petitioner is in possession of Ac.7-00 guntas in Survey No.485 of Pogallapally village, Mulakalapalli mandal, Khammam district, which is stated to be her ancestral property. While so, the 3rd respondent initiated Land Transfer Regulation proceedings against the petitioner and passed eviction orders on 19.12.2009. Challenging the eviction orders, she preferred an appeal before the 2nd respondent in CMA No.15 of 2011, but the 2nd respondent dismissed the appeal by order dated 17.01.2015 thereby confirming the orders of the 3rd respondent. Questioning the orders of the 2nd respondent, dated 17.01.2015, she preferred a revision petition before the 1st respondent, along with a stay petition seeking stay of implementation of eviction orders. The 1st respondent has not yet disposed of the revision or the stay application. Hence, the writ petition.

Considering the fact that the petitioner is an agriculturist and is in possession of the land since 1969, and considering the limited scope of relief sought by her in this writ petition, the writ petition is disposed of with a direction to the 1st respondent to pass orders either in the Stay application or in the revision itself, in accordance with law, within eight weeks from today. Till such time orders are passed either in the Stay petition or the revision, whichever is earlier, the parties shall maintain status quo as on today with regard to possession. No costs.
