HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.1299 of 2020 ORDER :

This writ petition is filed aggrieved by action of respondents 5 and 6 who are trying to take possession of petitioners over agricultural lands in Sy.No.640/A/2 admeasuring Ac.0-30 guntas, Sy.No.644/2 admeasuring Ac.0.36.5 guntas, Sy.No.640/A/1 admeasuring Ac.0-30 guntas, Sy.No.644/1 admeasuring Ac.0.36.5 guntas, Sy.No.640/A/3 admeasuring Ac.0-30 guntas, Sy.No.644/3 admeasuring Ac.0.36.5 guntas, Sy.No.640/A/4 admeasuring Ac.0-30 guntas, Sy.No.644/4 admeasuring Ac.0.36.5 guntas, Sy.No.640/A/5 admeasuring Ac.0-30 guntas, Sy.No.644/5 admeasuring Ac.0.36.5 guntas total extent of Ac.26-06 guntas situated at Eligaid Village Shivar and Eligaid Mandal, Peddapalli district.

Learned Assistant Government Pleader for Revenue says that respondents 1 to 6 are not concerned with the subject lands. Basing on the application of respondents 7 and 8, the survey authorities are undertaking survey.

Heard learned counsel for the petitioners, who, submits that the respondent-authorities are undertaking survey in respect of petitioners lands, to which respondents 7 and 8 have no rights and that the petitioners have no objection for

conducting of survey in respect of extents of lands owned by respondents 7 and 8.

Heard learned counsel for respondents 7 and 8, who, submits that there is also civil suit pending between the petitioners and respondents 7 and 8.

The above fact goes to show that there are disputes between the petitioners and respondents 7 and 8 and a civil suit is also pending between them. When there are disputes between the petitioners and unofficial respondents, it is not known how the grievance of petitioners could be gone into in the writ petition. However, disputed questions of fact cannot be gone into in the writ petition.

In view of the same, I do not see any reason to entertain the writ petition and accordingly, the same is dismissed. However, it is open for the petitioners to work out their remedies by approaching concerned civil Court. No costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
