O R D E R
The grievance of the petitioner is that the police authorities failed to register a case under Section 354 IPC against respondent 7 but only proceeded against him under Section 506 IPC. The incident to which the petitioner's grievance relates is stated to have taken place on 25.02.2013.
However, written instructions dated 06.07.2015 were furnished by the Sub-Inspector of Police, Renigunta Police Station, Chittoor District, stating that upon the complaint made by the petitioner in relation to the aforestated incident, Crime No.26 of 2013 was registered on the file of Renigunta Police Station under Sections 506 and 509 IPC. Admittedly, the first accused therein, the seventh respondent, is a Head Constable in Vadamalapet Police Station and his wife, Rama Devi, the eighth respondent, is the second accused. The Sub-Inspector further stated that upon completion of the investigation in the crime, a charge-sheet was filed against the accused before the learned V Additional Judicial Magistrate of First Class, Tirupati, on 16.08.2013 and the case was pending trial in C.C.No.168 of 2013.
In the light of the aforestated developments, as the competent Court is already seized of the matter, no direction can be given to the police authorities at this stage to register a fresh case under Section 354 IPC.
The writ petition is accordingly closed leaving it open to the petitioner to pursue appropriate legal remedies in relation to her grievance before the competent forum. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
