Heard the learned counsel for the petitioner and also the leaned Govt. Pleader for Minorities and Sri S.K.MahammedA.P.State Wakf Board-respondent No.2, needless to say R.3 is no other than the officer subordinate to the R.2 and R.3 served failed to attend.
Perused the prayer in the Writ Petition with the supporting affidavit and other material on record. The prayer in the writ petition reads as follows:- " To issue an appropriate writ, Order or direction especially in the nature of Writ of mandamus declaring the action of the respondents in appointing the Edga Managing Committee by its Proceedings F.No.10K-CTR-2014-Z-IV dated 09.06.2014 to perform Edga Namaz(prayers) in burial ground (Khabarstan) in S.No.814/ 2 Renigunta, Chittor District an extent of Ac.2.20Cts., further not considering petitioner representations dated 30.04.2017, reminder dated 28.05.2017 further representation dated 02.06.
2017 which is against the Hadees(Custom Rules), illegal, arbitrary and violation of Muslim law and consequently direct the Respondents to consider petitioner representations further issue orders to the Muslim community in Renigunta, Chittoor district restraining them to perform Eid Namaz in Sy.No.871/ 2 in an extent of Ac.2.20Cts., which is a Burial Ground(Khabarastan) and pass such other order or orders as this Hon'ble Court may deem fit and proper in the interest of justice."
The learned Standing Counsel for the Wakf Board-R.2 submits that he got instructions orally for disposal of the Writ Petition to consider the representation on own merits. Having regard to the above, the Writ Petition itself is disposed of directing the respondents to consider the representations of the petitioner dated 30.04.2017, 28.05.2017 and 02.06.2017 for which the petitioner can give afresh copies,
within one week from the date of receipt of the order, to the 2nd respondent and the 2nd respondent shall pass appropriate orders within four(4) weeks therefrom. Further grievance, if any, is left open.
