Though the matter is being listed under the caption 'for dismissal' on 02.07.2018, Sri Suresh Shiv Sagar, learned counsel for the appellant sought time for arguing the case. The learned counsel for the respondent appeared and opposed granting of time. Finally, the matter was directed to be listed on 05.07.2018 under the same caption. Despite the matter is being posted for dismissal, no seriousness is shown by the appellant. It is apparent that he has no interest in prosecuting the case.

Hence, the appeal is dismissed for non-prosecution. No costs.

As a sequel, miscellaneous petitions, if any, pending in this appeal shall stand closed.
