THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2398 of 2015 ORDER:
1. This Criminal Revision Case is filed by the petitioner-accused aggrieved by the order dated 5.10.2015 passed in Crl.M.P.No.280 of 2011 in Sessions Case No.289 of 2011 by the Principal Assistant Sessions Judge Mancherial.
2. The petitioner, who is alleged to have committed the offence punishable under Section 306 IPC, moved the above Crl.M.P. seeking to discharge him. The trial Court dismissed the said application. Hence the petitioner filed this revision.
3. Heard and perused the material available on record.
4. The allegation against the petitioner is that the deceased loved him earlier to her marriage with Margam Parasu Ramulu and after marriage, the petitioner is said to have made phone calls to her husband threatening him to leave the deceased and due to such acts, the deceased committed suicide.
5. It is the case of the petitioner that there is no direct evidence to show that the petitioner contacted the deceased or her husband and no prima facie material is available to proceed with the trial against the petitioner.
6. This Court has gone through the order passed by the trial Court. This Court does not find any illegality in the order under revision and hence, this Court is not inclined to interfere with the same. At this stage, the learned Counsel for the petitioner has not pressed for the relief sought for in this revision and he prayed for dispensing with the presence of the petitioner before the trial Court.
7. Under the above circumstances of the case and since the identity of the petitioner-
accused is not in question before the trial Court, this Court is of the view that if the presence of the petitioner is dispensed with, no prejudice would be caused.
8. Accordingly, the Criminal Revision Case is dismissed. However, the presence of the petitioner before the trial Court is dispensed with, except on the dates when his presence is insisted by the trial Court. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
